When supplying material that includes specialty metals in support of a DoD contract, you must comply with the requirements prescribed in DFARS 252.225-7014 entitled Preference for Domestic Specialty Metals, and Alternate I. Via Memorandum dated 29 January 2008, Shay D. Assad, Director, Defense Procurement and Acquisition Policy, issued Class Deviation 2008-00002 to implement newly enacted sections 804 and 884 of the FY 2008 National Defense Authorization Act which have changed the specialty metals restriction in 10 U.S.C. 2533b. This Class Deviation supersedes previous Class Deviations 2006-00004 and 2007-00011. This deviation directs the use of clauses 252.225-7014 entitled “Preference for Domestic Specialty Metals (Deviation 2008-00002)” and 252.225-7014, “Alternate 1 (Deviation 2008-00002)". These clauses are hereby applicable to awards made after 29 January 2008. Guidance is also provided in the memorandum for learning other changes to the law and for processing past non-compliances.
